Terms of Service

These Terms of Service (“Terms”) govern your access to and use of PlayaCMS (“we”, “our”, “the Service”) at playacms.com and camp-specific subdomains or custom domains. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

PlayaCMS is a software platform that helps Burning Man theme camps manage membership, applications, participant rosters, and related administrative tasks. We provide hosted software. We are not a camp ourselves, and we do not endorse or guarantee the actions of any camp using the Service.

2. Eligibility

You must be at least 18 years old to use PlayaCMS. By creating an account, you confirm that you meet this requirement.

3. Your account

• Accounts are created via email magic link. You are responsible for maintaining access to your email account.
• You are responsible for activity under your account until access is revoked.
• Impersonation, sharing credentials, or automated account creation are prohibited.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose
• Upload malicious code, spam, or content that violates third-party rights
• Attempt to probe, scan, or test the vulnerability of our systems
• Interfere with or disrupt the Service or its infrastructure
• Reverse-engineer, decompile, or extract source code from the Service
• Use the Service to collect personal data about individuals who have not consented

Violation may result in immediate account termination.

5. Camp data and content

Ownership

• You own your data. Data you or your camp members enter (applications, participant profiles, uploaded photos, camp branding) remains the property of the contributor or the camp, as applicable.
• PlayaCMS owns the Service itself— the software, database schema, design, and platform.
• You grant PlayaCMS a non-exclusive, worldwide license to host, store, and display your data only as necessary to provide the Service.

Camp admin responsibilities

If you act as a camp admin on PlayaCMS, you are responsible for:

• The accuracy of camp information you publish
• Obtaining consent from applicants and members before collecting their data via PlayaCMS
• Compliance with Burning Man Project policies and any applicable laws
• Decisions about applications, memberships, and participant data within your camp

PlayaCMS does not review or approve individual camp decisions.

6. Google Calendar integration

Where a camp chooses to connect a Google account for meeting scheduling, the use of Google APIs is subject to the Google API Services User Data Policy and our Privacy Policy. PlayaCMS is not affiliated with or endorsed by Google.

7. Fees

PlayaCMS is currently provided free of charge. If paid tiers are introduced in the future, pricing will be disclosed clearly and applied only to new subscriptions or with explicit opt-in.

8. Availability and disclaimers

• The Service is provided “as is” and “as available” without warranties of any kind, express or implied.
• We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any data will be preserved indefinitely.
• We are not responsible for any camp’s decisions, data, or conduct.

9. Limitation of liability

To the maximum extent permitted by law:

• Our aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid us in the 12 months preceding the claim, or CHF 100 if you paid no fees.
• We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill.

Nothing in these Terms excludes liability where exclusion is prohibited by law.

10. Termination

• You may stop using the Service and delete your account at any time.
• We may suspend or terminate your access for violation of these Terms, prolonged inactivity, or legal or technical reasons, with at least 14 days’ notice where practicable — except in cases of material breach or security risk.
• On termination, your personal data is handled per our Privacy Policy. Camp data owned by other camps is retained according to their instructions.

11. Changes to these Terms

We may update these Terms from time to time. For material changes, we will notify registered users by email at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

12. Governing law and jurisdiction

These Terms are governed by the substantive laws of Switzerland, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG).

Exclusive place of jurisdiction for any dispute arising out of or in connection with these Terms is the competent court in Zurich, Switzerland, subject to any mandatory consumer-protection forum your local law may provide.
